Employment and Industrial Relations
Our Employment & Pensions Team acts for many of the islands’ employers on an array of areas such as the drafting of contracts of employment, employment handbooks, employment policies, share option schemes, pension schemes and other related documents. GANADO also assists clients in relation to dismissals, termination of employment, redundancies (including collective redundancies), matters relative to employee information and consultation, the transfer of undertakings and employee protection, employment discrimination and harassment, industrial disputes and all types of litigation connected with such matters.
GANADO has in fact defended employers in the industrial tribunal since the tribunal’s establishment and has also a long standing experience in defending clients in employment disputes in front of the Maltese civil courts and the Malta court of appeal.
GANADO is also the majority shareholder in a service company named Opus Corporate Services Limited which provides employers with specialised advice and focused assistance relative to the immigration of executives into Malta and the obtaining of the relative work permits, residence permits and other documentation necessary for expats to work in Malta. Opus also provides specialised payroll services for small to medium enterprises which have established themselves in Malta.
GANADO in collaboration with Opus also publishes an employment law newsletter and organises a number of employment related courses and case studies in conjunction with the Malta Employers Association, the Institute of Legal Studies and other national and international organisations, aimed at ensuring that its clients and constantly updated with legal developments in this area of law.
Our Employment & Pensions Team also assists clients with the setting-up and authorisation of Trustees, Retirement Scheme Administrators and Asset Managers wanting to assist with the investment of pension funds. GANADO has indeed assisted the majority of Malta’s licensed retirement scheme administrators and pension schemes to obtain their licences required to operate in Malta and it has also assisted IORPs with obtaining registration in Malta in line with the relative EU Directive on the matter. A large number of our clients have also proceeded to seek QROPS (Qualifying Recognised Overseas Pension Scheme) or QNUPS (Qualified Non-UK Pension Scheme) status in the United Kingdom or similar overseas registrations.
